This case, a companion case to Brown, addressed the lingering problem of segregation in Washington, DC. Brown had been decided (on the same day as Bolling) on 14 Amendment grounds. The 14th Amendment, though, did not apply to DC, as it applies to states only. The Court, therefore, used the Due Process Clause of the 5th Amendment to desegregate the District of Columbia.
